TN Visas

TN/TD Visa was created after the signing of the North American Free Trade Agreement (NAFTA) in 1994 to facilitate the temporary transfer of professionals from Canada, the United States and Mexico.

From January 1st. of 2004, Mexican citizens can apply for this type of visa in the Embassy of the United States in Mexico City or any consulate of the United States in Mexico.

Mexican citizens with job offers for one of the positions that are listed in NAFTA are candidates for a TN.Visa. The spouse and unmarried children younger than 21 of a TN visa applicant are candidates for a TD visa. The list of NAFTA positions can be found at the following address (appendix 1603.D.1):

Please keep in mind that the jobs are professional positions that require certain qualifications. The applicant must have a “Título y Cédula Profesional”, with the exception of some professions. Other positions require a specific number of years of work experience. In all cases, the applicant must prove to the consul that the applicant has the academic capacity or necessary work experience for the TN visa.

Procedure:

  1. To ask for an Appointment:
    With the purpose of improving the service, we have put in practice a system of appointments. We counted on a telephone service to provide information on visas and to arrange an appointment. The call must become from a particular line, that are not of offices, businesses, cellular or houses nor public telephones. The information on visas also is available free so that you can receive also by fax, dialing (01)555-525-3786 and follows the verbal instructions of the service of “information by fax”, or through the Internet web page of the Embassy in Mexico:

  2. Document shipment
    A) Via E-mail (scanned documents or PDF files) to hermoTN@state.gov(recommendable option)

    B) Via Courier (ex. DHL, FEDEX, UPS, etc.) with Attention to TN Officer, to the following address:

  3. Each package requires of a previous review reason why You will not be interviewed the day that documentation is received.
    Documents must be send it before or immediately after making the appointment.
    You will have to bring the ORIGINAL document package in the day of the interview.
    Not to fulfill this requirement or if it presents/displays incomplete documentation will influence in the decision of your case.


  4. In order to obtain a renovation of your TN visa, it is necessary to return to review the present situation of the applicant and the company. The visa will not automatically be approved by the fact of to have obtained a previous one. A new supply of use as well as updated documentation will be necessary for the re-evaluation of the case. (If you have a TN visa issued from November 2006, please contact us before sending your documents).


  5. The package must include the following:
    A) Job offer letter:
    The job offer letter needs to be written in English by the company at which the TN visa applicant is going to work. Also, the letter must be very clear in the following five points:

    • Complete name of the applicant.
    • Position name and job description.
    • Annual salary
    • Length of contract
    • Academic degree and/or necessary experience for the position.

    This is an example of a Job Offer Letter in English.

    NOTE: The company will have to send the documents that support the information included in the job offer letter. Incomplete information or lack of documentation will delay the review and may affect the final decision of the case. Additional evidence may be required as necessary.

    B) Copies of the title and professional certificate, diploma, and other documents related to the applicant’s studies. The applicant will be required to present the original documents on the day of the interview.

    C) Resume.

    D) A Banamex receipt for 100 dollars as payment of the visa application fee (regardless of the age of the applicant). The payment can be made in any branch of Banamex (National Bank of Mexico) in Mexico

    E) Non-immigrant visa form EVAF DS-156 completely answered and signed by the applicant.

    F) Additional form DS-157 (only for men between 16 and 45 years old).

    G) Copy of the Mexican Passport (it must have at least 6 months remaining before expiration)

    H) Copies of previous and present visas.

    I) Company profile.

    J) Tax returns of the company (for the last 3 years).

    K) Marriage Certificate and Birth Certificates of siblings that will apply for a TD Visa.

Special Notes:
• TN / TD visas have a fee of $100.00 usd per year authorized (maximum three years) per applicant no matter his age.

• Visa will be issued and delivery 24 hrs. after interview.

• Lawyers nor company representatives are not allowed during the process inside the Consulate; Interviews are personal.
